in diesem Fall Anbieter von Telekommunikationsdienstleistungen („TKAnbieter“) gemäß § 3 Nr. 6 Telekommunikationsgesetz („TKG“) wird und der Arbeitnehmer Dritter gemäß § 3 Nr. 10 TKG ist (vgl. zuletzt Sassenberg/Mantz, BB 2013, 889 m.w.N.). Diese Ansicht mag zwar rechtsdogmatisch begründbar sein. Für Unternehmen führt sie jedoch zu so erheblichen Praxisschwierigkeiten, dass es dringend einer Korrektur, entweder durch den Gesetzgeber oder durch die den Anwendungsbereich des TKG bestimmende Rechtsprechung, bedarf.
